Hot Tub Deep Clean Service Agreement

This Deep Clean Service Agreement (“Agreement”) is entered into between Granite Spa Services/Eleven Ventures LLC (“Contractor”) and the customer (“Customer”).
By scheduling, approving, or purchasing a Deep Clean Service, the Customer agrees to the terms outlined below.
1. Scope of Deep Clean Service
The Contractor will perform a Deep Clean Service, which may include:

Draining the hot tub/spa
-
Cleaning the interior shell
-
Cleaning the exterior cabinet
-
Cleaning accessible surfaces and components
-
Refilling the spa
-
Restarting the spa system
This service is intended to provide a thorough periodic cleaning of the spa system and surfaces and is separate from routine maintenance services.
2. Optional Pipe Cleaning Service
An optional service called Pipe Cleaning may be requested by the Customer.
Pipe Cleaning may include:

Adding a specialized pipe cleaning solution through the pipes of the spa
-
Running the spa to circulate the purge through internal pipes
-
Removing buildup or biofilm from internal pipes
-
Draining the spa following the purge process
Pipe Cleaning is recommended but not required during a Deep Clean.
The Contractor does not guarantee complete removal of all biofilm, as plumbing configurations vary between spa models and manufacturers.
3. Optional Winterizing / Summerizing Service
The Contractor may provide a Winterizing or Summerizing Service for Customers who do not plan to use their spa for an extended period of time.
This service may include:

Draining the spa
-
Cleaning the interior shell
-
Removing residual water where reasonably accessible
-
Adding a protective solution to help preserve plumbing lines and components
-
Preparing the spa system for extended non-use
This service does not include refilling the spa.
The Customer acknowledges and agrees:

This service is intended to reduce risk but does not guarantee prevention of freezing, damage, or deterioration
-
Residual water may remain in plumbing lines, pumps, or components
-
Environmental factors (temperature, weather, power loss, etc.) are outside the Company’s control
The Contractor shall not be liable for damage occurring during the period of non-use, including but not limited to:
-
Frozen or cracked pipes
-
Pump or heater damage
-
Plumbing leaks
-
Component deterioration
The Customer is responsible for:
-
Ensuring the spa remains in appropriate condition during the non-use period
-
Monitoring environmental conditions where applicable
-
Scheduling reactivation service when ready to return the spa to use
The Contractor recommends that Customers schedule a professional restart service before using the spa again after an extended shutdown.
4. Water Disposal Authorization
The Deep Clean Service requires draining the spa.
The Customer agrees to authorize an appropriate drainage location for spa water. Possible drainage locations include:

Yard or landscaping areas
-
Driveways
-
Designated drainage areas
-
Other locations approved by the Customer
The Customer acknowledges that The Contractor does not determine or verify local drainage regulations and that the Customer is responsible for ensuring the drainage location complies with:

Local laws or ordinances
-
HOA regulations
-
Property restrictions
The Contractor shall not be liable for issues resulting from the drainage location selected or approved by the Customer.
5. Drainage and Flooding Liability
Draining a spa may release hundreds of gallons of water, which may travel across surfaces depending on property grading and drainage conditions.
The Contractor does not evaluate:

Property grading
-
Soil absorption
-
Drainage systems
-
Storm drains
-
Landscaping conditions
The Customer acknowledges and agrees that The Contractor shall not be liable for flooding, runoff, pooling, erosion, or water intrusion caused by draining the spa in the location approved by the Customer.
This includes, but is not limited to:
-
Water entering garages, basements, or window wells
-
Water pooling on patios, decks, or driveways
-
Landscaping damage
-
Soil erosion
-
Overflowing drains
-
Water reaching neighboring properties
The Contractor reserves the right to decline draining the spa in locations that appear unsafe or likely to cause property damage.
6. Chlorine Dissipation Requirement
Prior to the scheduled service, the Customer agrees to allow chlorine or sanitizer levels to dissipate to safe levels.
The Customer acknowledges:

High chlorine levels may damage landscaping or drainage areas
-
Excess sanitizer may require additional time before draining
The Contractor reserves the right to:
-
Delay draining until sanitizer levels are safe
-
Reschedule service if chemical levels are excessively high
Additional time required due to unsafe chemical levels may result in additional charges.
7. Access to Spa
The Customer agrees to provide:

Clear access to the spa
-
Ability to remove the spa cover
-
Active electrical service to the spa
-
Access to a water source for refill
The Contractor is not responsible for delays caused by blocked access, locked gates, or unavailable utilities.
If service cannot be completed due to access limitations, a trip charge may apply.
8. Water Supply
The Customer agrees to provide access to a working outdoor water source for refilling the spa.
The Contractor is not responsible for:

Slow refill times
-
Low water pressure
-
Water supply interruptions
-
Municipal water restrictions
9. Spa Condition Disclosure
Draining and refilling a spa may reveal pre-existing mechanical or plumbing issues, including but not limited to:
-
Leaks
-
Pump failures
-
Heater malfunctions
-
Plumbing issues
-
Electrical issues
The Contractor is not responsible for pre-existing equipment issues that become visible or apparent during or after the service.
10. Restart and Equipment Function Disclaimer
Older or stressed spa components may fail during or after draining and restarting.
The Customer acknowledges that draining and restarting a spa may place stress on:
-
Pumps
-
Heaters
-
Seals
-
Plumbing connections
-
Electrical components
The Contractor does not guarantee that the spa will restart or operate properly after the Deep Clean service.
The Contractor is not liable for equipment failure occurring during or after restart, including but not limited to:
-
Pump failure
-
Heater failure
-
Plumbing leaks
-
Electrical faults
-
Circuit board failure
The Contractor may assist with basic troubleshooting but does not perform repair services unless separately agreed upon.
11. Winter Conditions and Freeze Risk
Draining and refilling a spa during cold weather may expose plumbing components to freezing temperatures.
The Contractor will take reasonable steps to complete the service efficiently; however, the Customer acknowledges that freezing conditions may still pose risk.
The Contractor shall not be liable for damage caused by freezing temperatures, including:

Frozen plumbing lines
-
Cracked pipes or fittings
-
Pump or heater damage
-
Frozen valves or jets
The Contractor reserves the right to reschedule or modify services if freezing conditions present elevated risk.
If the Customer requests service to proceed despite freezing conditions, the Customer assumes responsibility for potential freeze-related damage.
12. Pet and Property Interference
The Customer agrees to secure pets and ensure animals remain away from the spa area during service.
The Contractor technicians may use hoses, tools, electrical equipment, and cleaning chemicals that may present hazards to animals.
The Contractor is not responsible for delays, equipment damage, or injury to pets caused by animal interference.
If pets interfere with service or create unsafe conditions, the technician may pause or discontinue service until the area is secured.
If service cannot be completed due to pet interference, a trip charge or rescheduling fee may apply.
13. Technician Safety and Unsafe Property Conditions
The Contractor technicians reserve the right to work in a safe environment.
The Customer agrees to maintain safe conditions around the spa area, including:

Safe walking surfaces
-
Clear access paths
-
Adequate lighting when necessary
-
Absence of hazardous conditions
The Contractor may refuse, pause, or discontinue service if unsafe conditions exist.
If service cannot be completed due to unsafe conditions, a trip charge or rescheduling fee may apply.
14. Hidden Damage Discovery
Previously hidden damage may become visible once the spa is drained or inspected.
The Contractor is not responsible for pre-existing damage discovered during service.
15. Payment Terms
Payment for the Deep Clean Service is due upon completion of the service.
The Customer is granted a 21-day grace period from the invoice date.
If payment is not received within 21 days:
-
A 10% interest charge will be applied
-
An additional 10% charge will be applied every Monday thereafter until paid
The Contractor reserves the right to pursue collections and recover costs where permitted by law.
16. Service Rescheduling
At least 24 hours notice is required to reschedule.
Failure to provide notice may result in a fee.
17. Limitation of Liability
The Contractor’ total liability shall not exceed the amount paid for the service.
18. Governing Law and Venue
This Agreement shall be governed by the laws of the State of Utah.
Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts located in the State of Utah, in the county where the service was performed or where The Contractor/Eleven Ventures LLC maintains its principal place of business.
19. Attorney Fees
In the event of any dispute arising from this Agreement, the prevailing party shall be entitled to recover reasonable attorney fees and costs, to the extent permitted by Utah law.
20. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
21. Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions or agreements.
22. Agreement Acceptance
By scheduling or purchasing this service, the Customer agrees to all terms outlined above.
